The following terms of service (the "Terms of Service"), govern your access to and use of the Nkeih website and mobile application, including all content, functionality and services offered on or through www.nkeih.com or the Nkeih mobile application (the "Site") by BUYSAFE LLC. (30 N. Gould St. Ste R, Sheridan, WY 82801, USA) is referred to herein collectively as "nkeih", "we" or "our" and "you" or "user" refers to you as the user of the site.

Please read the terms of service carefully before you start using the site. By using the site, opening an account or clicking to accept or agree to the terms of service when this option is offered to you, you accept and agree, on behalf of yourself or on behalf of your employer or any other entity (if applicable) , to be bound by and to abide by these Terms of Service and Nkeih's Payment Terms. You also acknowledge that you have read and understood our privacy policy. If you do not want to agree to these Terms of Service or the Privacy Policy, you must not access or use the Site. This site is offered and available to users who are at least 18 years old and of legal age to form a binding contract. If you are under 18 and at least 13 years old, you are only permitted to use the Site through an account owned by a parent or legal guardian with their appropriate permission. If you are under 13, you are not authorized to use Nkeih's site or services. By using the Site, you represent and warrant that you meet all of the foregoing eligibility requirements. If you do not meet all of these conditions, you must not access or use the site.

The original language of these terms of use, as well as all other texts on the site, is English. Nkeih makes this translation available for convenience only. In the event of any conflicts between the original English version and any translation, the English version shall prevail.

 

Key terms

Buyers/customers are users who purchase services using Nkeih as a personal buyer (customers) or as an intermediary (buyers).

The request  is the need of a buyer/customer or a seller clearly indicating his wish to use the service(s) of Nkeih.

The agreement is a negotiated and binding arrangement between buyers and sellers on a plan of action.

The order is the formal agreement between a Buyer/Client/Seller and Nkeih after a request is made by the Buyer/Client/Seller.

Sellers are users who offer, provide services or sell goods online on various platforms.

Overview (Main terms, in brief)

• Only registered users can buy and sell on Nkeih. Registration is free. By registering for an account, you agree to provide us with accurate, complete and updated information and must not create an account for fraudulent or misleading purposes. You are solely responsible for all activity on your account and for maintaining the confidentiality and security of your password. We are not responsible for any act or omission by you in connection with your account.

• The price of the services varies according to Nkeih. Our advisory service is free, however, we can accept donations. Fees for personal shopping services start from €4 up to 0.05% of the purchase amount. The fees for mediation services are 0.1% of the transaction amount.

• Buyers pay Nkeih in advance to create an order (see payment terms).

• The request details are proof that the order has been placed.

• For fees and payments, please read the payment terms

• Sellers must fulfill their orders and cannot cancel them regularly or without reason. Canceling orders affects the reputation of sellers.

• Users may not offer or accept payments using any method other than that which follows Nkeih's payment policies.

• We care about your privacy. You can read our privacy policy here.

• Users agree to abide by the Nkeih Community Standards, which are a set of behavioral rules and guidelines, applicable to the Nkeih Community in addition to these Terms of Service, as updated from time to time.

 

SELLERS

• Sellers communicate with buyers to get an agreement.

• Sellers are responsible for payment of all direct or indirect taxes, including GST, VAT or income tax, which may apply to them depending on their residence, location or otherwise, under provisions of their jurisdiction. Sellers represent and warrant that they comply, and will comply at all times, with their obligations under the income tax provisions in their jurisdiction.

• Sellers communicate with Nkeih about the deal.

• Each contract concluded and completed credits your account with income equal to 90% of the purchase amount.

• Nkeih accredits sellers once an order is completed. See our "Commands" section below for a definition of a completed command.

• For security reasons, Nkeih may temporarily cancel the accreditation of the seller's account in order to prevent any fraudulent or illicit activity. This may be the result of security issues, inappropriate behavior reported by other users.

• Sellers are responsible for obtaining a general liability insurance policy with coverage amounts sufficient to cover all risks associated with the performance of their services.

• Users may be removed from the Site by Nkeih for violations of these Terms of Service and/or our Community Standards, which may include (but are not limited to) the following violations and/or materials:

  • Illegal or Fraudulent Services

  • Copyright infringement, trademark infringement, and violation of a third party's terms of service, reported through our Intellectual Property Claims Policy.

  • Adult Services, Pornographic, Inappropriate/Obscene

  • Services that are withdrawn for the violations mentioned above may result in the suspension of the seller's account.

 

You are responsible for providing any terms of sale, privacy or other terms, and other information or statements related to your Seller Content that you wish to apply to your interactions with users. Such terms, information or statements are not binding on us and shall not conflict with these Terms and Conditions for Sellers and our other applicable terms and policies. We only act when we are required to act as an intermediary

• You grant us a worldwide, non-exclusive, transferable, assignable, royalty-free license to host, use, distribute, modify, perform, copy, publicly perform, make available, display, translate, and create derivative works of any Seller Content that you provide or that we access as part of the Commerce and Merchant Features, including photos and videos in connection with Other Companies' Products. You agree that you have all necessary rights in the Seller Content to grant us the license described above.

 

Stock pictures

When using stock images, you represent and warrant that:

• You may not sell, modify, reuse, resell, distribute, display, reproduce, or make any other use of the stock images.

• The use of stock images is prohibited:

• on a stand-alone basis, with no other content;

• for pornographic, defamatory or other illegal purposes;

• as templates used to create multiple copies of the same Gig;

• for the purpose of enabling the sharing of the image file; Where

• in logos, trademarks, service marks, or any other marks or identifiers.

• If stock images of people are used in connection with a sensitive, unflattering, or controversial topic, you must include a statement that the image is used for illustrative purposes only and that the person is a model.

• You may not enable "right-click" functionality in stock images, remove metadata from stock images, or reverse engineer, decompile, or disassemble the stock image(s) to enable downloading or use of stock images on a stand-alone basis.

• No ownership or copyright in stock images is granted to you.

 

Shipping physical deliverables

The shipping price factor is discussed upon agreement.

• Buyers will be asked to provide a shipping address.

• Sellers are responsible for all shipping arrangements once buyer provides shipping address.

• In the event that Nkeih is an intermediary, Nkeih does not handle or guarantee the shipping, tracking, quality and condition of the items or their delivery and will not be responsible or liable for any damages or other problems. resulting from shipment.

• In the case of Nkeih as personal buyer, Nkeih does not take responsibility for the shipment, quality and condition of the items or their delivery and will not be responsible for any damage or other problem resulting from the shipment.

• A tracking number is a great way to avoid shipping disputes. We ask that you send us the tracking number if available.

 

BUYERS

• You are not allowed to offer direct payments to sellers.

• Buyers are required to send payment from seller directly to Nkeih.

CUSTOMER

• Customers are required to send their money to Nkeih before any purchase.

• Nkeih as a personal shopper Nkeih is not responsible for the shipping, quality and condition of the items or their delivery and cannot be held responsible for any damage or other problem resulting from shipping.

• Nkeih keeps 50% of the fees in case of reimbursement.

 

Purchases

• Payment terms are those provided by Nkeih during the agreement.

 

ORDERS

Once the payment is confirmed, your order will be created Nkeih will have to play its part according to the terms of the contract.

• Sellers must provide proof of delivery/fulfillment to Nkeih and Buyers depending on the service that has been purchased.

• An order is complete after both parties agree on delivery/execution with Nkeih mediation. An order will automatically be considered complete if there is no feedback from the receiving party and no change request has been submitted within 14 days after Nkeih has been contacted for the submission.

• We encourage our buyers and sellers to try to resolve disputes with each other. If for some reason it fails after several attempts, users can contact Nkeih's customer support department for assistance.

• Some Services may require Buyers and Sellers to meet in person in order for the Seller to perform the Service. In such cases, users should note that Nkeih does not guarantee the behavior, conduct, safety, fitness or ability of buyers or sellers. Buyers and Sellers agree that the entire risk resulting from their encounter and/or their use or performance of the Local Services remains solely with them, and Nkeih has no liability or obligation related to the Local Services provided by the Sellers. In the event that the Service is performed at Buyers' premises, Buyers are encouraged to maintain appropriate insurance policies to cover their liability as owner of the premises. Nkeih's Terms of Service and Community Standards remain applicable to orders that are made outside of the Marketplace (including, but not limited to, the restrictions below on illegal use, inappropriate behavior and language, and targeted abuse).

Order processing

• When a buyer places an order, the seller is notified by email.

• Sellers are required to meet the delivery time they stated when communicating with buyers. In the event of non-compliance with this deadline, the buyer may cancel the order.

• Sellers must send proof of delivery/fulfilment to Nkeih via Nkeih's messaging system.

• Users are responsible for scanning all transferred files for viruses and malware. Nkeih will not be held responsible for any damage, which may occur due to the use of the site, the use of the content or the transferred files.

• Buyers can ask Nkeih for a revision/cancellation if the delivered materials do not match the seller's description during the contract or if they do not match the requirements sent to the seller at the beginning of the order process.

 

Disputes and Cancellations

We encourage our buyers and sellers to try to resolve disputes with each other. If for some reason this step fails after several attempts, users can contact NKEIH Customer Support for assistance. For more information on disputes, order cancellations and refunds, please refer to the Payments Terms.

User behavior and protection

Nkeih enables people around the world to create, share, sell and buy almost any service they need at an unbeatable price.

Nkeih maintains a friendly, community and professional environment. Users must keep this spirit while participating in any activity or extension of Nkeih. This section is about the expected conduct that users must adhere to when interacting with each other on Nkeih.

To report a violation of our Terms of Service and/or Community Standards, user misconduct, or questions regarding your account, please contact our Customer Support team.

• Nkeih does not provide any guarantee on the level of service offered to buyers.

• Nkeih does not provide protection for users who interact outside of the Nkeih platform.

• All exchanges of information and files must be carried out exclusively on the Nkeih platform.

• Rude, abusive, incorrect or violent messages will not be tolerated and may result in a warning or the suspension/deletion of your account.

• Nkeih is open to everyone. You agree not to discriminate against another user based on gender, race, age, religious affiliation, sexual orientation or otherwise and you acknowledge that such discrimination may result in the suspension/deletion of your account.

• Users may not submit proposals or solicit parties introduced by Nkeih to contract, commit or pay outside of Nkeih.

 

Services/goods

• Users may report Services/Goods to Customer Support that may be in violation of Nkeih's Terms of Service based on the reported Service's repeated similarity to pre-existing Services.

• Sellers warrant that any content included in their Services is original designed by Sellers and does not infringe any third party rights, including but not limited to copyrights, trademarks or service marks . In the event that certain music or video sequences are incorporated into the services, the Sellers declare and guarantee that they hold a valid license allowing them to use these music and/or video sequences and to include them in the services.

• Nkeih will respond to clear and complete notices of alleged copyright or trademark infringement. Our intellectual property complaints procedures can be viewed.

 

Reporting Violations

If you find any content that may violate our Terms of Service and/or our Community Standards, you should report it to us through the appropriate channels created to deal with such issues, as set out in our Terms of Service. All cases are reviewed by our Trust & Safety team. In order to protect the privacy of individuals, the results of the survey are not communicated. You can consult our privacy policy for more information.

 

Violations

Users may receive a warning on their account for violations of our Terms of Service and/or Community Standards or any inappropriate user behavior reported to our Trust and Safety team. A warning will be sent to the user's email address and will be displayed for that user on the Site. Warnings do not limit account activity, but may result in loss of seller status or permanent account deactivation depending on the severity of the violation.

 

Unauthorized use

Adult and pornography services - Nkeih does not allow the exchange of adult or pornographic material and services.

Inappropriate behavior and language - Communication on Nkeih should be friendly, constructive and professional. Nkeih condemns bullying, harassment, and hate speech towards others. We allow users a way to exchange messages between individuals, a system to rate orders, and to engage on broader platforms like our community forum and social media pages.

Phishing and Spam - Member safety is a top priority. Any attempt to post or send malicious content with the intent of compromising another member's account or computing environment is strictly prohibited. Please respect our members' privacy by not contacting them with offers, questions, suggestions, or anything not directly related to their Gigs or orders.

Privacy and Identity - You may not post or view other people's private and confidential information. Any exchange of personal information necessary to perform a service must be provided in the order page. Sellers also confirm that any information they receive from Buyer, which is not in the public domain, will not be used for any purpose other than delivering the work to Buyer. Any user who engages and communicates outside of Nkeih will not be protected by our terms of service.

Authentic Nkeih Profile - You may not create a false identity on Nkeih, misrepresent your identity, create an Nkeih profile for someone other than yourself (a real person), or use or attempt to use the account or another user's information; Your profile information, including your description, skills, location, etc., while may remain anonymous, must be accurate and complete and may not be misleading, illegal, offensive or otherwise harmful. Nkeih reserves the right to require users to go through a verification process in order to use the site (whether using ID, phone, camera, etc.)

Intellectual Property Claims - Nkeih will respond to clear and complete notices of alleged copyright or trademark infringement, and/or violation of a third party's terms of service. Our procedures for intellectual property claims may be reviewed.

 

Fraud / Illegal Use - You may not use Nkeih for any illegal purpose or to conduct illegal activities.

Abuse and spam

Multiple Accounts - To prevent fraud and abuse, users are limited to one active Nkeih account. Any additional accounts determined to have been created to circumvent the guidelines, promote competitive advantages, or mislead the Nkeih community will be disabled. Mass creation of accounts may result in the deactivation of all linked accounts. Note: Any violation of Nkeih's Terms of Service and/or our Community Standards is cause for permanent suspension of all accounts.

Targeted Abuse - We do not tolerate users who engage in targeted abuse or harassment of other users on Nkeih. This includes creating multiple new accounts to harass members through our message or order system.

 

Selling accounts - You cannot buy or sell Nkeih accounts.

Ownership Restrictions

The site, including its general layout, look and feel, design, information, content and other materials available on the site, is the exclusive property of Nkeih and is protected by copyright, trademark and other intellectual property laws. Users have no right to, and specifically agree not to, do any of the following with respect to the Site or any part, component or extension of the Site (including its mobile applications): (i) copy, transfer, adapt, modify, distribute, transmit, display, create derivative works from, publish, or reproduce it in any way; (ii) disassemble, decompile, reverse engineer or otherwise attempt to derive its source code, underlying ideas, algorithms, structure or organization; (iii) remove any copyright, identification or other proprietary notices; (iv) use automation software (bots), hacks, modifications (mods) or any other unauthorized third-party software designed to modify the Site; (v) attempt to gain unauthorized access to, interfere with, damage or disrupt the Site and any computer systems or networks connected to the Site; (vi) circumvent, remove, alter, disable, degrade or defeat any technological measure or protection of the content of the Site; (vii) use any robot, spider, crawler or other automatic device, process, software or request that intercepts, "mines", scrapes or otherwise accesses the Site to monitor, mine, copy or otherwise collect information or data from or through the Site, or engage in any manual process to do the same, (viii) introduce viruses, Trojan horses, (viii) introduce into our systems viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful, (ix) use the site in any way that could damage, disable, overburden or impair the site, or interfere with enjoyment of the Site by other users or (x) access or use the Site in any manner not expressly permitted by these Terms of Use. Users also agree not to permit or authorize any other person to do any of the foregoing.

Except for the limited right to use the Site under these Terms of Use, Nkeih owns all right, title and interest in the Site (including all intellectual property rights) and you agree not to take any action incompatible with these property rights. We reserve all rights in relation to the site and its content (other than the TOS) including, without limitation, the exclusive right to create derivative works.

 

Reaction rights

To the extent that you provide Nkeih with comments, suggestions or other feedback regarding the Nkeih Platform or the Site as a whole, as well as other Nkeih products or services (collectively, "Feedback"), you will be deemed to have granted to Nkeih an exclusive, royalty-free, fully-paid, perpetual, irrevocable, worldwide property right in the Feedback. Nkeih is not obliged to implement the comments it may receive from users.

 

Privacy

Sellers should be aware that Buyers may be required to disclose certain Confidential Information that will be used by Sellers in connection with the delivery of Work Ordered, and to protect such Confidential Information from unauthorized use or disclosure. Therefore, Sellers agree to treat any information received from Buyers as highly sensitive, top secret and classified material. Without derogating from the generality of the foregoing, Sellers specifically agree to (i) maintain all such information in the strictest confidence; (ii) not disclose this information to third parties; (iii) not to use this information for any purpose other than the delivery of the work ordered; and (iv) not to copy or reproduce this information without the authorization of the buyer.

 

Terms and conditions

• Nkeih reserves the right to place any account on hold or permanently disable accounts due to violation of these Terms of Service and/or our Community Standards or due to any illegal or improper use of the Site or Services.

• Violation of Nkeih's Terms of Service and/or our Community Standards may result in the permanent deactivation of your account.

• Users with deactivated accounts will not be able to sell or buy on Nkeih.

• Users who have violated our Terms of Service and/or Community Standards and whose account has been deactivated can contact our Customer Support team for more information about the violation and account status.

• Users have the ability to enable account security features to protect their account from unauthorized use.

• Users must be able to verify ownership of their account through customer support by providing documentation proving ownership of that account.

• Disputes should be handled using Nkeih's dispute resolution tools ('Resolution Center' on the order page) or by contacting Nkeih's customer support.

• Nkeih may make changes to its Terms of Service from time to time. When these changes are made, Nkeih will make a new copy of the Terms of Service available on this page.

• You understand and agree that if you use Nkeih after the date the Terms of Service have changed, Nkeih will consider your use as acceptance of the updated Terms of Service.

 

User Generated Content

User Generated Content ("UGC") refers to content added by users as opposed to content created by the Site. All content uploaded to Nkeih by our users (buyers and sellers) is user-generated content. Nkeih does not check any user-uploaded/user-created content for suitability, violations of copyrights, trademarks, other rights or violations and the user who uploads/creates such content shall be solely responsible of it and the consequences of its use, disclosure, storage or transmission. By uploading or creating content on the Nkeih platform, you represent and warrant that you own or have obtained all rights, licenses, consents, permissions, power and/or authority, necessary to use and/or upload this content and that this Content or its use on the Site does not (a) infringe or violate any intellectual property, proprietary or privacy, data protection or publicity rights of any third party; (b) does not violate applicable local, state, federal and international laws, regulations and conventions; and/or (c) does not violate your or any third party's policies and/or terms of service. We urge everyone to report violations, along with proof of ownership where appropriate. Reported infringing content may be removed or disabled.

Furthermore, Nkeih is not responsible for the content, quality or level of service provided by sellers (even if they are Pro sellers, Top Rated sellers, offer promoted contracts or otherwise). We make no warranties with respect to contracts, their delivery, communications between buyers and sellers, and logos created through the logo maker. We encourage users to use our rating system, our community and their common sense to choose the appropriate services.

By offering a service, the seller agrees to have sufficient permissions, rights and/or licenses to provide, sell or resell the service that is offered on Nkeih. Sellers who advertise their contract or logo design created by the logo creator online must comply with the laws and terms of service of the advertising platform or website used to advertise. Failure to do so may result in removal of the contract or logo creator's logo, as applicable, and may lead to suspension of the seller's account.

For specific terms relating to intellectual property rights and to report claims of copyright infringement (DMCA Notice) or trademark infringement - please see our Intellectual Property Claims Policy which forms part of these Terms of Use. 'use. Note that our policy is, in appropriate circumstances, to disable and/or terminate the accounts of users who are repeat infringers.

 

Property

Ownership and Limitations: When purchasing a Nkeih service/good, unless otherwise specified on the request page, when the service or good is delivered, and subject to payment, the buyer is granted all rights intellectual property, including but not limited to copyright in work delivered by Seller, and Seller waives all moral rights therein. Accordingly, the Seller expressly assigns to the Buyer the copyright in the work delivered. Any transfer and assignment of intellectual property to Buyer is subject to payment in full for the Gig, and the delivery cannot be used if payment is canceled for any reason. For the avoidance of doubt, in the case of custom-created work (such as artistic work, design work, report generation, etc.), the delivered work and its copyright shall be the sole property of Buyer, and upon delivery Seller agrees to assign to Buyer all right, title and interest in and to the Work delivered, subject to these Terms of Service. Some Gigs (including custom created work) charge additional payments (through Gig Extras) for commercial use license. This means that if you are purchasing the Gig for personal use, you will own all rights necessary for that use and will not need the commercial use license. If you intend to use it for compensation or other consideration, or for any purpose directly or indirectly related to a business or any other for-profit enterprise, you will need to purchase the Commercial Use License through of a Gig Extra and you will have more extensive rights that will cover your commercial use.

For Voice Over Gigs, when the work is delivered, and subject to payment, the buyer purchases basic rights, (meaning the buyer pays a one-time fee allowing them to use the work forever and at all purposes except commercials, radio, television and the Internet). If you intend to use voice-over to promote a product and/or service (excluding paid marketing channels), you will need to purchase commercial rights (Buy-Out) through Gig Extra. If you intend to use voice-over in radio, television and internet commercials, you will need to purchase the full broadcast rights (Buy-Out) through Gig Extra. Furthermore, users (both buyers and sellers) agree that, unless they explicitly state otherwise, content that users voluntarily create/upload on Nkeih, including Gig texts, photos, videos, usernames, user photos, user videos and any other information, including display of delivered work, may be used by Nkeih without consideration for marketing and/or other goals.

 

Disclaimer of Warranties

USE OF THE SITE, ITS CONTENT AND ANY SERVICE OR MATERIALS OBTAINED THROUGH THE SITE IS AT YOUR SOLE RISK. THE SITE, ITS CONTENT AND ANY SERVICE OR ITEMS OBTAINED THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER THE NKEIH NOR ANY PERSON ASSOCIATED WITH THE NKEIH MAKES ANY WARRANTY OR REPRESENTATION REGARDING THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY OR AVAILABILITY OF THE SITE.
